What to Do If You’re Involved in an Uber Accident

As rideshare apps like Uber and Lyft become more popular, new legal questions associated with these businesses arise. For example, who is responsible if you experience a serious injury while riding in an Uber? To ensure that you can cover your medical bills and other costs associated with the injury, take these steps if you are involved in an Uber accident.

Seek Medical Attention

Immediately after the accident, call 911 if you can do so. Even if you don’t think you have any injuries, you should still see a doctor. Keep a copy of the medical records associated with your injury. The vehicle that you were in will cover your medical expenses, lost wages, and other damages caused by the crash.

Document the Scene

Take photos and videos of the accident scene and the vehicles involved. Talk to bystanders who may have witnessed the crash and ask for their full names and contact information. Document the name and contact information of all drivers involved in the crash, including your Uber driver. Save screenshots of the receipt for your ride. If you cannot take these steps because you are injured, ask a friend or family member to take action on your behalf. You can also hire an attorney to gather evidence and advocate for your interests.

Review State Auto Accident Laws

Because New York is a no-fault state for auto accident insurance, the injured person must first pursue compensation from his or her personal injury protection (PIP) policy. You will file a claim with the auto insurance company of the vehicle that you were in at the time of the crash. You can also sue the responsible driver for damages that like pain and suffering and economic damages. In New York, you must have a severe injury to file an auto accident claim in court. The law defines a serious injury as any injury that causes at least 90 days of disability, limits the use of an organ, system, or function of the body, fractures bones, or causes serious disfigurement.
